Let MLAs elect the Delhi Chief Minister


LG can revive Delhi assembly: Supreme Court

...it would be open for the President or the Lieutenant Governor 
  • to either dissolve the assembly to call for fresh elections or 
  • invite a political party to form government if it stakes claim.
In India, we conduct elections to elect the MLAs for the State Legislative Assembly and MPs for the Parliament.

We don't conduct elections to elect the Chief Minister or the Prime Minister.

We don't ask the people to choose their Chief Minister for the state; or the Prime Minister for the nation.

If we ask the people of India to choose their state Chief Minister and nation Prime Minister, they will do without any confusion.

814 Millions people of India, without any confusion can choose the nation's Prime Minister.

But we don't ask them; we don't put that question to the people; then how could you expect an answer.

Take for instance, the Delhi Government.

We did follow all the democratic process; but still we are in a state of confusion.

If it is in Pondicherry, then we could understand.

In Delhi; the capital of largest democracy on planet earth; we couldn't find an answer to a question.

Do we understand the question?

The question is, who is the Chief Minister of Delhi.

How could we find it?

Assume that we conduct a re-election for Delhi.
Again, we are not going to ask the people; who is the Chief Minister;
So, we will not get an answer.

Is it so difficult to understand this?

Nothing politics here; it is simple logic.

Fortunately, we don't have this kind of process for games like Cricket or Soccer.
Otherwise, in the middle of the game; the captain resigns and go home.

Are we ready to ask the question to the people directly.
Then, let us go for a new, fresh election.

Who ever wants to become the Chief Minister give your name.
we will put it in the ballot.

For instance, Arvind Kejriwal wants to contest for the Chief Minister post.
Kiran Bedi also wants to contest for the Chief Minister post.
Subramanian Swamy wants to contest for the Chief Minister post.
and ten others.

Put all those ten or twenty names in the ballot paper.
No Symbols.
In the nation capital; all citizens are literate; they could read the names of the candidate.

Remember; we are not electing the MLAs;
we are electing the Chief Minister.

Without any confusion, one person will be elected as the Chief Minister by the people of Delhi.

This option is not possible right now; we need to amend the constitution.

So, let us follow the current version of the constitution.

As per the constitution, people elect their representatives; that is MLAs.

Yes. people did. without confusion, people elected their MLAs.
All 70 MLAs are elected by the people of Delhi.

So, there is no need for a re-election.

Now, as the current version of the constitution, these 70 MLAs elect the Chief Minister.

That sounds good; that is doable.

So, let the Lieutenant Governor invite all 70 MLAs to the assembly hall.

Then, let the Lieutenant Governor  ask the MLAs;

"Any one of you would like to become the Chief Minister?"

If no one raise the hand, then let the Lieutenant Governor  say:
"Okay. Let me continue to be the Chief Executive of Delhi. But I would like to seek your legislative help in resolving issues."

So, the Lieutenant Governor  shall send the bills to the Legislature;
let the MLAs discuss and pass those bills;
or reject those bills.

That is how the United States of America functions.
The President sends the bill to the Congress for discussion.
If Congress pass the bill; the President signs it;
the bill become a law.

Okay, let us explore the second option:

Only one MLA wants to become the Chief Minister.
It sounds good. Then let us make that person as the Chief Minister of Delhi.

The third option is; more than one MLA, would like to become the Chief Minister.

In that case, let the Lieutenant Governor conduct a simple election on the floor.

Let each MLA write a name for the Chief Minister post and drop it in a box.
Let the Lieutenant Governor  count those 70 notes.
Out of that count, very likely one person may get more votes.
Declare that person as the Chief Minister of Delhi.

So, give an opportunity to all 70 MLAs to cast their vote and elect the Chief Minister.

Delhi Model is very crucial.
It is a sample for our democracy.

Most probably, the current Parliament may follow the Delhi model.

So, the Supreme Court have delivered their responsibility of the Judicial Branch.
Now, the ball is in the Lieutenant Governor court.
The Executive Branch has to solve the puzzle and find a resolution.
Who is the Chief Minister.

Next month, the President may have to face the same situation for the Parliament.
Who is the Prime Minister of India.

One fact is obvious.
Narendra Modi will not be the Prime Minister of India in 2014.
People would like Narendra Modi to become the PM; but not the MPs.
So, anyone else will become the Prime Minister of India in 2014.

So, the resolution for Delhi is very critical for this time period.

Let us be prepared for the crisis and challenges.

Let us conduct a voting process on the floor of the Parliament and provide an equal opportunity to all MPs; even independent MPs to cast their vote and elect the Prime Minister of India.
